Reporting under the Single-use plastics Directive

Introduction

Legal Background

Directive 2019/904 of the European Union and the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment (henceforth "SUP Directive") aims at preventing and reducing the negative impact of certain plastic products on the (marine) environment and on human health, promoting the transition to a circular economy, and contributing to the efficient functioning of the internal market.

The SUP Directive applies different measures to different single-use plastic products, plus fishing gear and oxo-degradable plastic, ranging from consumption reduction provisions (Article 4), to restrictions on placing on the market (Article 5), product requirements (Article 6), marking requirements (Article 7), Extended producer responsibility (Article 8), separate collection (Article 9) and to awareness raising (Article 10).

To allow the monitoring of progress towards the objectives and targets of the SUP Directive, its Article 13 (Information systems and reporting) establishes that Member States shall report the data and information covering the following:

Post consumption waste from filters for tobacco products	SUPD Art 13(f): data on the post-consumption waste of single-use plastic products listed in Section III of Part E of the Annex that has been collected in accordance with Article 8(3).	2023	End June-2025

Article 13(1) of the SUP Directive states that Member States shall report these data and information electronically within 18 months of the end of the reporting year for which they were collected. The first reporting period shall be the calendar year 2022, which will cover items (a), (b), (c) and (d). This means that the deadline for reporting these items will be end of June 2024. The reporting of (e) and (f) will be the calendar year 2023 (to be reporter until end of June 2025). See details in table above.

Article 13(2) of the SUP Directive states also that the data and information reported by Member States shall be accompanied by a quality check report where, among other aspects, the methods for the calculations and for data verification and control are described.

The data and information shall be reported in the format established by the Commission. For that, the Commission has produced a series of implementing decisions laying down the format and methodologies for the data reporting, and the content and format of quality check report:

SUPD Article 13 (a) and (b)	Commission Implementing Decision (EU) 2022/162 of 4 February 2022 lays down the rules for the application of Directive (EU) 2019/904 of the European Parliament and of the Council as regards the calculation, verification and reporting on the reduction in the consumption of certain single-use plastic products and the measures taken by Member States to achieve such reduction.
SUPD Article 13 (c)	Commission Implementing Decision (EU) 2021/1752 of 1 October 2021 lays down rules for the application of Directive (EU) 2019/904 of the European Parliament and of the Council as regards the calculation, verification and reporting of data on the separate collection of waste single-use plastic beverage bottles.
SUPD Article 13 (d)	Commission Implementing Decision (EU) 2021/958 of 31 May 2021 lays down the format for reporting data and information on fishing gear placed on the market and waste fishing gear collected in Member States and the format for the quality check report in accordance with Articles 13(1)(d) and 13(2) of Directive (EU) 2019/904 of the European Parliament and of the Council.
